1. What Heirly is
Heirly is a software platform that helps executors catalogue estate belongings, invite beneficiaries to express preferences, and facilitate a transparent allocation process. It is designed to make a difficult task more structured and less contentious for grieving families.
Heirly is not a law firm and does not provide legal advice. Heirly does not provide probate services, act as an executor, or offer financial advice. The executor of the estate remains solely and legally responsible for the proper administration of the estate, for compliance with applicable probate or administration law, and for any decisions made during the estate process.
If you need legal advice about estate administration, you should consult a qualified solicitor, barrister, or other legal professional in your jurisdiction.
2. Eligibility
You must be 18 years of age or older to create an estate, register an account, or participate in an estate as a beneficiary on Heirly. By using Heirly, you represent and warrant that you meet this requirement.
3. Accounts and responsibilities
The executor who creates an estate on Heirly is responsible for:
- Accuracy of information: The executor is responsible for the accuracy of all information entered into the estate, including item descriptions, estimated or confirmed values, and beneficiary details.
- Legal authority to act: The executor is responsible for ensuring they hold a valid legal basis — such as a grant of probate, letters of administration, or a jurisdiction-equivalent authority — to act as executor and to manage the distribution of estate assets before using Heirly for that purpose.
- Beneficiary capacity: The executor is responsible for ensuring that each beneficiary they invite has the legal capacity to participate in the estate process.
- Account security: You are responsible for maintaining the confidentiality of any access credentials and for all activity that occurs through your account or magic link.
4. Free and paid tiers
Free tier
The free tier allows the executor to catalogue up to 10 estate items and run sentimental allocation rounds at no cost. No credit card is required.
Full Estate (paid tier)
The paid tier unlocks unlimited items, financial allocation rounds, the settlement calculator, full PDF report export, and audit log export. The fee is a one-time payment per estate — there are no subscriptions, monthly charges, or renewals. Current pricing is shown at heirly.app/pricing and may be charged in NZD, GBP, or AUD depending on your location.
Refund policy
The one-time fee is non-refundable once an estate has been activated on the paid tier, except where required by applicable consumer protection law (including the New Zealand Consumer Guarantees Act, Australian Consumer Law, and UK consumer legislation) or at Heirly's reasonable discretion in exceptional circumstances.
5. Acceptable use
You agree not to use Heirly to:
- Create a fraudulent or fictitious estate, or impersonate an executor without lawful authority to act
- Circumvent legal or fiduciary obligations, or use the platform to facilitate any unlawful activity
- Upload content that is illegal, infringes third-party intellectual property rights, is defamatory, or is otherwise harmful
- Attempt to gain access to another user's account or another estate without authorisation
- Interfere with or disrupt the security or integrity of the platform or its infrastructure
- Use the platform for any purpose other than the legitimate administration of a real estate
Heirly reserves the right to suspend or terminate access immediately for violations of this section.
6. AI-generated valuations
Heirly uses AI to suggest titles and estimated values for estate items based on photographs and descriptions you upload. These suggestions are provided as guidance only.
AI-generated valuations do not constitute professional appraisal, valuation, or financial advice. Heirly makes no warranty as to the accuracy, completeness, or fitness for purpose of any AI-estimated value.
For high-value items, disputed items, or any item where accurate valuation materially affects the estate distribution, users are solely responsible for obtaining a professional independent appraisal. Reliance on AI-generated estimates in place of professional valuation is at the executor's own risk.
7. Data and beneficiary information
By adding a beneficiary to an estate, the executor confirms that they have an appropriate basis to provide that person's name, email address, and relevant estate information to Heirly for the purpose of estate administration.
Beneficiaries receive an email notification when they are added to an estate. They must actively accept their invitation before they can view or participate in the estate. Executors should not add individuals as beneficiaries without having an appropriate reason to do so.

8. Intellectual property
Heirly and The P80 Project Limited retain all rights to the platform, software, design, branding, and all content produced by Heirly. Nothing in these terms grants you any licence to use Heirly's intellectual property other than as necessary to use the platform for its intended purpose.
You retain full ownership of the estate data, photographs, and other content you upload to Heirly. By uploading content, you grant Heirly a limited, non-exclusive licence to store and process that content solely for the purpose of providing the service to you.
9. Limitation of liability
Heirly is provided "as is" and "as available" without warranties of any kind, express or implied, except as required by applicable consumer law.
To the maximum extent permitted by applicable law, Heirly and The P80 Project Limited are not liable for:
- Disputes between family members or beneficiaries arising from or during the estate process
- The outcome of any estate allocation or settlement decision made using the platform
- Loss or damage arising from reliance on AI-generated item valuations
- Any indirect, consequential, special, or incidental loss or damage
Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited under the New Zealand Consumer Guarantees Act, the Australian Consumer Law, or UK consumer protection legislation. Your statutory rights are not affected.
10. Termination
Heirly may suspend or terminate your access to the platform at any time if you breach these terms, engage in fraudulent activity, or use the platform in a manner that causes harm to others or to Heirly. We will give reasonable notice where possible, except where immediate action is necessary.
You may close your account and request deletion of your personal data at any time by contacting us at [email protected]. Closing your account does not entitle you to a refund of any paid estate fees.
11. Governing law
These terms are governed by the laws of New Zealand. If you are a consumer resident in a country that provides mandatory legal protections which cannot be excluded by agreement — including but not limited to consumer guarantee, consumer protection, or data protection laws — nothing in these terms limits or excludes those rights.
12. Changes to these terms
We may update these Terms of Service from time to time. Where changes are material, we will notify registered users by email at least 30 days before the changes take effect. The updated version will be posted at heirly.app/terms with the revised date shown at the top.
Continued use of Heirly after the effective date of updated terms constitutes acceptance of those terms.
